I’ve been caught drink driving and wil lose my job if I’m disqualified
Being caught drink driving doesn’t automatically mean you will be disqualified from holding or obtaining a drivers licence. There are a number of factors that a Magistrate will consider in determining whether you should be disqualified or not.

In what circumstances can I not be breath tested?
  • if you have been admitted to hospital unless the medical practitioner does not object
  • if it appears your injuries would prevent it
  • 2 hours after driving your vehicle (applies to the breath analysis but not breath test)
  • at your home or usual place of abode.

What happens if I refuse the breath test or analysis
You may be charged with refusing the breath test or analysis and will be required to appear in court. A monetary penalty and disqualification may be imposed on you.
